In a case where the other driver is uninsured, you may be pursuing a claim through your own insurance company through your personal injury protection or uninsured motorist coverage. While your company may seem to be treating you well and working diligently to process your claim, remember that the interests of the insurance company are not necessarily your best interests. Insurance companies want to minimize the amount they payout in claims. They will therefore try to pay as little as they can on your claim, or deny the claim altogether if they can. When the claim cannot be denied, a common tactic is to closely scrutinize your original application for errors or incomplete information and see if there is any way they can simply cancel your policy without paying the claim.
The Effect of Comparative Negligence
A common defense tactic is to shift the blame onto the plaintiff by claiming that you were responsible for causing the accident, or that you were not properly restrained which caused your injuries to be more severe than they would have been.
Even if you were partly responsible for causing the accident or injuries, you may still be able to recover from the other party. Under Texas law, so long as you not more at fault than the other party (50% or less), then you can pursue a claim against the other driver for his or her negligence. However, any verdict in your favor will be reduced by the percentage of responsibility allocated to you at trial.
